Employers Weigh Up Mock Tribunal

EEF, the manufacturers’ organisation, is offering employers in the east of England the chance to see the workings of employment tribunals from the inside...and to have their say on the outcome of a fictitious case linked to sexual and sexual orientation discrimination.

With employment tribunal hearings at record levels, the mock tribunal at EEF’s offices in Cambridge on June 30 will provide an opportunity to see how a tribunal operates and to understand the process that leads to adjudication.

The mock tribunal case hinges on a claim of constructive dismissal by a gay employee who alleges that when he spurned the advances of his female manager, she made life so difficult for him that he had to resign.

“This event not only provides an insight into the workings of employment tribunals it also shows the potential effect of the new Equality Act introduced last October, which covers every area of discrimination the workplace,” says Jim Davison, EEF’s Region Director in the east of England. “Employers will gain an insight into the importance of setting and communicating clear boundaries in terms of acceptable workplace behaviour.”

The mock tribunal will be conducted by EEF employment law specialists with extensive experience of tribunal proceedings and will demonstrate the potential pitfalls for employers. Although the outcome will be determined by the mock tribunal panel, delegates will be able to test their legal reasoning by offering their own adjudication after hearing the evidence.  

The mock tribunal will cover the following procedures:

  • Evidence in chief by the respondent and claimant witnesses
  • Cross examination of the witnesses
  • Summing up of evidence by the representatives
  • Delivery of the decision by a panel

The proceedings will be frozen at various points to allow step-by-step explanation of the process and to give the opportunity to ask questions.
